The HC of Kerala while hearing a matrimonial appeal before it on 21st May observed that “Though the photographs may reflect that the couple was in a happy mood that does not reflect as to how they were living together. At the time of taking the photographs, they seem to be in a happy mood. But that by itself does not mean that the couple was leading a happy married life,” The above observation came in the case of Anish Jacob V. Rinku Jacob. In which the husband relied upon certain photographs to prove happy bond exists between the couple.
In the present case where the wife files a petition before the family court for divorce on the grounds of cruelty as husband was demanding patrimony from the wife. The family court accepted the wife’s contention and granted divorce. The husband challenged the family court’s decision before the HC in the current matter, husband in his petition placed photographs of the couple in happy mood proving that there was no existence of cruelty. However, the HC rejected the husband’s contention and held that photograph may show that they are in happy mood but such photographs are not sufficient prove that there is no existence of cruelty. The HC upon hearing the issue upheld the decision of family court and did not interfered with the lower court’s judgment.
