The Election Commission of India was issued a notice by the Delhi High Court, in a petition to seek the banning of political parties with religious, ethnic, linguistic or casteist connotations. Examples of parties such as Hindu Sena, All India Majilis-e-Ittehadul Muslimeen, Indian Union Muslim League was cited by Petitioner Ashwini Kuamr Upadhyaya. Additionally it also states that the Indian National Congress has a flag similar to the Indian tricolor.
The petition was filed under the provisions of Section 123(3) of the Representation of the People's Act, 1951, which states that, appealing for votes on the grounds of religion, race, caste, community or language, national symbols, such as national flag or national emblem, is a corrupt practice. Allowing the parties to have names with religious, casteist, ethinic or linguistic connotations and symbols affect free and fair elections.
Further, the petitioner asked for the de-registering of such parties if they fail to rename themselves within a period of three months. The Election Commission has been asked to give its response before the 17th of July 2019.
