Deepak Mishra, the Chief Justice of India, Monday, while defending the role of Judiciary said that Judiciary should not indulge itself in the policy making areas, and should restrict itself to interpretation only. The CJI also mentioned that the work of the court is to protect the Fundamental rights of the citizens, and is obliged to perform its duty.
Discussing the role of Legislature, Executive and Judiciary, Justice Mishra said that it’s the Constitutional ideology, Constitutional philosophy and the spirit of it, that keeps the country alive, and Constitution is the only bond which binds them together. Constitution of India is very detailed and the roles and working of Legislature, Executive and Judiciary have been well defined.
Justice Mishra said:
“Nobody intends, nobody desires to enter upon the policy making areas. We don’t make policies but we interpret policies and that’s our duty. Citizens have been guaranteed with fundamental rights and governing entities are not allowed to encroach upon it. The moment, they encroach or if there is apprehension, the judiciary rises to stand by them.”
He also mentioned about the Vishakha judgement in which the rights of women’s were protected by the court and cited many more judgements which protected the children rights. He said that all the three organs should cooperate with each other and follow the Constitutional values, rule and morals.
President Ram Nath Kovind showed his concern over less number of SC/ST and OBC appointments in Judiciary. He also raised apprehension regarding the speedy justice system which is very expensive which makes the poor people deprive of justice. He also said that:
“Pro bono service to the poor should not be left at the will of lawyers, but the same should be institutionalized. The information and technology should be fully utilized by the judiciary so that the delay can be avoided. This will not only decongest the books, but also enhance the governance,”.
