All the petitioners who have filed this petition are young engineering students, filing this petition under Article 226 of Indian Constitution before the Bombay High Court. However, these petitioners are final year students of three year diploma course and not the four year engineering course. The students enrolled in the four year course go through 16 years of paradigm (10 years of schooling+ 2 years of higher secondary+ 4 years of graduation) whereas the students enrolled in the three year course go through 13 years of education (10 years of schooling+ 3 years of diploma). The diploma holders have an advantage that they enter the job market 3 years prior to the 4 year degree holder. However, the job market does not operate on such considerations. The degree holders are preferred over the diploma holders.
It is for this reason that the diploma holders get what is called the “lateral entry” into engineering colleges. After completing 3 years of diploma, they can laterally enroll into second year of the four year engineering degree, this way they have equal number of years in education, i.e. 16 years. The Common Entrance Test (CET) for admission in engineering colleges is administered by the State Government’s Department of Technical Education (DTE). The number of seats is decided by the All India Council for Technical Education (AICTE). By a notification dated 31st December 2018, AICTE reduced the percentage of lateral entry from 20% to 10%.
The Supreme Court dismissed the petition and observed that “the world is so fiercely competitive may be regrettable, but we can do nothing to change it.”
