In a major blow to the state human right commission, the Chhattisgarh high court has held that the commission is only a recommendatory body and doesn’t possesses the power to direct payment of compensation. The court further observed that the commission has no jurisdiction to pass a directing order, it may pass the order to recommend the measures to concerned authorities.
The high court was hearing an appeal filed by the state electricity board against the order of the human rights commission directing the board to pay a compensation of about 6.3 lakhs. The matter came before the commission when a petition was filed by an individual against the forceful installation of electricity poles in his agricultural field. The commission considered it as a gross violation of the fundamental rights and ordered the compensation.
“Human Rights Commission is only empowered to make a recommendation. It has no adjudicatory jurisdiction and the Government/its authority has an obligation to consider the recommendation of the Commission in accordance with law.”
