Cancellation of all light motor vehicle driving licence issued to illiterate persons was ordered by the Rajasthan High Court Division Bench.
A stay ordered was passed in writ appeal filed by Deepak Singh by a bench comprising Justice Mohammad Rafiq and Justice Narendra Singh Dhaddha
Justice Sanjeev Prakash Sharma said that “ Illiterate drivers are a menace to pedestrians”. He also held that a licence cannot be issued to an illiterate person as he is a hazard to the public as they cannot recognise the signs and the caution written on the boards for the safety for the public on the highways and roads.
The Justice also propounded that the Motors vehicles Act are also to be framed in the viewpoint of the public using the roads rather than the only the advantages person who seeks the licence.
This order was overall condemned and the Motors vehicle Act does not dictate any specific or minimum educational qualification required to acquire a licence.
