The Apex Court of India, the Supreme Court, on the 1st of July,2019, has dismissed a Public Interest Litigation application that was filed seeking directions from the Supreme Court to the centre to designate and declare Pakistan-Occupied Kashmir (PoK) and Gilgit as assembly seats.
The petition had pointed out that twenty four assembly seats have been carved out by the Indian government from PoK and Gilgit which are Indian territories but under the illegal occupation of Pakistan.
The bench which decided on the petition was headed by Chief Justice Ranjan Gogoi. A fine of Rs. 50,000 was also imposed on former RAW official, Mr. Ram Kumar Yadav, for filing a legally untenable petition.
Formerly, in March 2017, a BJP MP had moved a private member’s bill in the Lok Sabha, seeking a reservation of five seats in the Lok Sabha and one Rajya Sabha seat for the residents of Pok and Gilgit. Nishikant dubey, the person behind piloting the bill, expressed extreme surprise that the State legislature of Jammu and Kashmir does not take into account this territory, which is under the illegal occupation of Pakistan. The legislation had asked for the insertion of Article 370-A, which would add five seats to the House of People and one seat to the Council of States. Dubey had tried to introduce the bill twice before, in November 2014 and February 2015. However, on both occasions the speaker of the Deputy Lok Sabha disallowed it. Dubey had strongly argued that he will approach all the members of the assembly and try to build a consensus among all for the passing of this landmark legislation. He highlighted that the primary objective of introducing this legislation is to undo the atrocities committed by Pakistan in these areas and to correct all the wrongs that has been faced by the residents of PoK and Gilgit since the 1950s.
