Bench comprising of Jst. R.K.Agarwal, Jst.Arun Mishraand and Jst. AM Khanwilkar on 1st December dismissed the petition by CJAR which had alleged the involvement of Higher Judiciary Officers into corruption related to medical college admission. The case was filed against retired Orissa High Court Judge I M Quddusi .The amount of fine so recovered will be used for SCBA Welfare Funds (Supreme Court Bar Association).
Attorney General KK Venugopal appeared for the Government and Advocate Prashant Bhushan for CJAR (Campaign for Judicial Accountability and Reforms).Arguments were put forth by both the sides. Arguments given on behalf of CJAR were that it was exigent to appoint SIT to be headed by retired Chief Justice of India which will safeguard the faith in whole system of Judiciary. It was also postulated that such sensitive matters as this should not be left to the executive control.
On the other hand it was contended by Government were the petition was unvaried from the previously filed petition, there was nothing novel in the petition capable of being argued as these arguments have already been laid before in petition filed by Kamini Jaiswal.
It was dismissed by the court terming the petition as frivolous and scandalous without any reasonable basis, it was held that such PILs do more harm than serving the public interest.
Adv. Prashant Bhushan also added that such acts of Supreme Court imposing costs on NGOs which work for securing the Judicial Accountability amounts to intimidation, for not letting such petitions being filed that keeps a check on unparalleled power of Judiciary.
