The court of Additional Sessions Judge Arun Bharadwaj noted that the Delhi Police and prosecution are expected not to share the contents of charge sheet against the congress MP Dr.Shashi Tharoor in the criminal case relating to the abetment of the suicide of his wife Sunanda Pushkar with the third parties. Rule 11 of CCS (Conduct) Rules dealing with the Official Information and manual of Office Procedure was referred by the court which restrains officials from sharing official documents with any other third party. It was further noted that since this provision is applicable to prosecution and police with full force, no order of the court is required for its fulfilment.
The additional Sessions Court at Rouse Avenue Complex for trying cases against MP/MLAs has given the liberty to the prosecution to have a consult with the experts the content of the charge sheet for the purpose of the trail. However, it was directed that such discloser should not be made to any third party. During the proceedings misinformation regarding the case was spread.
It was pleased by the accused that the misinformation was spread and he has reasonable apprehension that the misinformation will hinder the legal proceedings... It was also pleaded that the misinformation will be detrimental to the Tharoor’s right to reputation, right to privacy and right to receive a fair trial. Therefore, it was pleaded to direct not to share the charge sheet and any other document with any third party. Delhi High court Rules and Sections 8(1) (b) RTI act was also highlighted by him.
Subsequently, court directed the Police and the Prosecution not to disclose the matter of the charge sheet with any third party.
