Senior Advocate Mukul Rohatgi pleaded before the Supreme Court bench led by the Chief Justice of India Ranjan Gogoi, for urgent hearing of a writ petition filed by two Member of Legislative Assembly (MLA) of Karnataka for holding a trust vote in the assembly. The Supreme Court rejected the plea stating it was ‘impossible’.
The petitioners, Karnataka Pragnyavantha Janatha Party MLA R Shankar and independent MLA Nagesh prayed before the court to issue directions to hold the trust vote before 5 pm on Monday (22/07/2019) following their withdrawal of support to the Congress-Janata Dal (Secular) coalition.
The trust vote, initially scheduled for Thursday (18/072019), did not take place. The governor,Vajubhai Vala, had instructed the speaker to conduct the trust vote by 1:30 pm on Thursday. When the instruction was not followed, the governor extended the deadline to 6 pm on the same day. Even this was also defied.
The petitioners demand that the governor’s order has to be followed as per Article 172(5) of the constitution. The petitioners also claimed that the minority government is taking advantage of the stalled situation and deciding several executive actions like transferring Police Officers, IAS officers and also other government officials.
