A writ petition filed against the state of Rajasthan for not granting any special relaxation and concession for the disabled candidates in the Rajasthan Eligibility Examination for Teachers was heard by the Rajasthan High Court.
The petitioners accused the State of Rajasthan’s policy which does not grant any concessions or relaxation in marks to persons with disabilities in Rajasthan Eligibility Examination for Teachers. The petitioners put forward Vikas Sankhala & others. Vs. Vikas Kumar Agarwal & others, 2017, SCC 350, as precedent and said that such grant was given by the state in the past.
The bench comprising Justice S. Ravindra Bhat and Justice Veerendra Singh Siradhana dismissed the state’s argument that, when such grants were given in the past, especially in the years 2011 and 2012, there were peculiar circumstances.
The court, taking under consideration, the Rights of Persons with Disabilities Act, 2016, concluded that 20 per cent concession must be granted to persons with disabilities in the on-going recruitment process in Rajasthan Eligibility Examination for Teachers to the extent of the unfulfilled vacancies of the year 2017. The court also asked the state to revise the results of REET 2015 and REET 2017 based on the 20 per cent concession.
