The human body generally experiences a lot of factors to determine where the true power resides in, be it money, family or education. But the most important factor which drives a person to get motivated all the time is Information. Information is something which keeps every individual truly driven with regards to almost every event that happens in the world. Information, which is generally used interchangeably with Knowledge, is the driving force of every person to keep oneself involved in every other aspect of society.
By looking at the importance of this factor, Parliament of India also tool a note of it and granted a right to information to every citizen of India through Right To Information Act, 2005. A right which authorizes every person to seek any information regarding any governmental affair or activity.
Recently, a non-profit organization Pravasi Legal Cell filed a petition before Supreme Court demanding an online RTI portal for all the citizens living across the country and outside too. The NGO sought a direction to all the state governments and the central government as well to provide the online RTI portal facility to all the NRI's to obtain information through the electronic mode. The petition was filed by the NGO through Advocate Jose Abraham.
The petition raised question on one of the most effective provisions in the RTI Act which is section 7(1) stating that information sought for concerns like life or liberty of a person, the same shall be provided within 48 hours of the receipt of the request is not at all effective under the existing system and it severely affects the life and liberty of many citizens.
The Apex Court bench headed by Justice N.V. Ramana issued the order after hearing the plea of the NGO and directed the central government and all the state governments to establish a Right to Information(RTI) portal to enable people to file online applications for information from any department.
The lawyer from the NGO argued that the process should be made easy and viable along with timely achievablility for the citizens and requested the bench to direct the government to establish the online portals. The petitioner described that the main target of the said problem is the section of migrants including Non-Residents of India who have to take the physical route to attain any kind of information from any concerned department which involves a lot of discrepancies and issues. The petitioner also argued that the physical process is time consuming and it defeats the very purpose of the legislation.
