Soon after the historic decision taken by the Indian Government, the citizens of India all across the globe have put forth their views. It led to a huge controversy and a political discussion not only in India but also across the border.
The abrogation of Article 370 of Indian Constitution which granted special status to the state of Jammu and Kashmir led to a disruptive war amongst the political parties as well as common people. Not only the scrapping of the Article was a reason, the bifurcation of J&K into two Union Territories has also taken the storm of this so called political move to another level.
The Supreme Court was flooded with loads of petitions challenging different aspects of this abrogation. Petitions challenging the presidential order issued in the state of J&K and abrogation of Article 370 were seen by the courts. Along with such challenges, petitions also challenged the restrictions imposed in the state and the curfew measures in the state and the consequences faced by the common people due to that were raised up.
The Supreme Court bench was considering as many as 14 petitions concerning the issue. The bench of Hon'ble CJI Ranjan Gogoi, Hon'ble Mr. Justice S A Bobde and Hon'ble Mr. Justice Abdul Nazeer referred the matter to constitution bench challenging the validity of the scrapping of special status of Jammu and Kashmir and the conversion of the state into two Union Territorries.
The bench of Hon'ble CJI Ranjan Gogoi, Hon'ble Mr. Justice S A Bobde and Hon'ble Mr. Justice Abdul Nazeer said that the matters will be heard in October. The objections raised by the Attorney General and Solicitor General regarding the issuance of notice were overruled by the bench.
The objections raised by the AG and SG were that the decision might lead to benefit across the border on an international political level .
Notably, the matter is going to be heard by the Constitutional Bench hearing the petitions challenging the abrogation of special status given to the state of J&K in one of the historic moves taken by the Government of India.
