Supreme Court has directed the centre to frame appropriate rules regarding abysmally high fees charged by lawyers. There had been previous recommendations by the Law Commission (131st Report) in this regard but only in the case of B. Sunitha v. The State of Telengana & Anr. that the SC felt an urgency to bring a cap on the fees charged by the lawyers. The case was heard by bench of Jst.AK Goel and Jst. UU Lalit. In this case the lawyer filed a case for the client under sec.138 of Negotiable instruments act. After the award was pronounced, in addition to the fees already paid, the lawyer put a charge even on the compensation awarded by the court.
The legal system of any country is there is to eradicate injustice and not breed it. It is the duty of people into legal profession to protect the rights and to help in securing justice. Professional Ethics are must for any system to work properly be it justice delivery. Both floor and ceiling prices have to be mentioned as suggested by Law Commission. The court also highlighted that there have been no actions on the report of commission and it is high time the government should take action and guard the needy persons from the wrath of exorbitant fees charged by the lawyers.
