Youth BAR association and Advocate Roopak Kansal filed a petition in the Supreme Court seeking the protection of reputation and integrity of individuals who have been allegedly accused of sexual offences, until proven guilty. As the social media owns the whole world, people believe baseless accusations and do not critically think and evaluate before arriving at conclusions on their own.
The petitioners also contended that section 228-A of the Indian Penal Code provides for protection of the identity of the victim in cases of sexual offences, but fails to secure the integrity and identity of the accused.
The petitioners also held that, “false accusations sometimes destroy the entire life of an innocent person and there have been instances where the person who has been falselyimplicated has even committed suicide. It does not only destroy an individual’s life but creates a social stigma to the family members too. Need of the hour demands that some preventive measures must be taken so as to avoid and to deal with such situations in the interest of justice.”
A Supreme Court bench headed by Justice S.A. Bobde was hearing the matter and issued a notice.
