The Congress had approached the Supreme Court praying that the poll body should tally 25 per cent of all ballots in Gujarat with voter slips printed by the Voter-Verifiable Paper Audit Trail (VVPAT) machines before declaring the election results.
The Apex Court of the Country turned down the said plea and refused to interfere in the election Procedure arguing that it cannot override the Election Commission's complete discretion to conduct polls. The court, however, told the party that it can file a "proper plea" seeking reforms in the polling process.
Senior Lawyer and also Senior Congress Leader Abhishek Manu Singhvi and Kapil Sibal appeared before the court on behalf of Congress at the court.
VVPAT machines print a paper slip where it is shown for whom the voter had casted the ballot for. The voter can witness the slip in the polling booth, however the voters are not allowed to take it away from the voting centre. The slip is stored in a compartment,
The Election Commission, if it necessity arises, can then tally the slips from a particular Electronic Voting Machine's (EVM's) compartment and tally the paper records with the votes that had been cast in the machine.
VVPATs were introduced for the first time in Maharashtra Elections. This time it has been deployed in each and every voting centre in Gujarat as well as Himachal Pradesh.
The Election Commission has decided to conduct all elections with the EVM-VVPAT combination. It is believed that this was in response to allegations of EVM tampering that were raised in the days following the Uttar Pradesh Assembly election.
