The amended Motor Vehicles Act was passed in July, 2019 by both the Houses of Parliament imposing heavy fines for traffic violations. This Act came into force from September 1, 2019 and since then, though it has been only a few days, the fines mentioned in the Act have created hue and cry among the people. Many states, like Madhya Pradesh, Telangana, Rajasthan, have not yet implemented the Act saying that the fines imposed are very high and the people need time to get acquainted with the new rules.
The Act has, however, been implemented in Gujarat but with a reduction in the fines imposed by the Centre. The fine for not wearing a helmet under the MV Act is Rs. 1,000 but in Gujarat, the fine collected by the traffic police would be only Rs. 500. Similarly, fine for driving a vehicle without license would amount to Rs. 2,000 and Rs. 3,000 for two-wheelers and three-wheelers respectively in Gujarat. The fine mentioned for the same under the Act is Rs. 5,000. Whereas, the Act imposes a fine of Rs. 10,000 for obstructing an ambulance or any emergency vehicle, the Gujarat traffic police would collect only Rs. 1,000 for the same.
The Gujarat government has cut down on the fines imposed under the new MV Act for violation of pollution norms from Rs. 10,000 to Rs. 1,000 and Rs. 3,000 for Light Motor Vehicles and other types of vehicles respectively. Driving a vehicle without seat belt would now attract a fine of Rs. 500 in Gujarat which was intended to be Rs. 1,000 under the Act. While the Central government has imposed fine of Rs. 1,000 for pillion riders for not wearing helmet, the Gujarat government has not implemented this rule at all.
For triple riding and speeding more than the limit, the Act imposes a fine of Rs. 1,000 and Rs. 2,000 respectively. In Gujarat, however, the fines collected for the above violations would be Rs. 100 and Rs. 1,500 respectively. Driving a commercial vehicle without having fitness certificate would attract a fine of Rs. 500 for three wheeler and Rs. 5,000 for bigger vehicles. The Gujarat government also mentioned that people can store their documents in digital form in Digi locker application and can produce them as and when asked for.
These provisions along with the reduced amount would come into force from September 16, 2019 in Gujarat. The Chief Minister of Gujarat, Vijay Rupani, said that the main motive of the government is not to collect fines but to ensure that the people are safe while driving on the road. All these reductions in the fines are made deliberately by the government, considering the sentiments of the people. It wasalso mentioned by the Gujarat CM that the reductions have not been made to show leniency to violators but to ensure safety of people and though the fines seem to be less they are ten times more than what used to be imposed before the Motor Vehicle Act was even passed.
