The Hon'ble bench of Supreme Court of India passed a stay order on the felling of the trees in the Aarey coleny in the Mumbai Suburbs. Earlier, a petition was filed in the Bombay High Court which was dismissed by the court on the grounds that the matter has already been decided by the court earlier. There was widespread condemn in the country when the news of the tress being cut down went viral on the social media. Also, many environmental activitsts were arrested during the whole facade.
The vacation bench of the Supreme Court decided to take up the issue after some law students wrote a letter to the Chief Justice of India Mr. Rajan Gagoi. They were represented by senior advocates Sanjay Hedge and Gopal. The Advocates contended that the question whether Aarey is a forest or not is to be considered by the Supreme Court. Also, National Green Tribunal still has to consider whether the area is a eco sensitive zone. Despite all these issues pending the government of Maharashtra did not refrain from cutting the trees and rather took advantage of the holidays going on the Supreme Court.
Earlier, the environmental activists filed petitions before the Bombay High Court which were rejected. Solicitor General Tushar Mehta appearing on behalf of the Maharashtra Government undertook that no further trees would be cut. "Whatever has to be cut is Cut, there would not be further cutting" said Tushar Mehta. He said that the matter could be heard after the holidays on October 21. He assured that no further trees will be cut down till the matter is heard before the Hon'ble court.
