The Bombay Bar Association (BBA) on thursday resolved and showed serious concern over the " Strong Disapproval" of the elevation case of High Court of Bombay Judge Hon'ble Mr. Justice Akhil A Kureshi to the Chief Justice of Tripura High Court. The Supreme Court Collegium resolution over the elevation of Justice Kureshi to the Chief Justice of Madhaya Pradesh High Court but the Bar Association of the Bombay recommended the elevation should be done to the High Court of Tripiura as the Chief Justice and not as the Chief Justice of Madhya Pradesh High Court. The Bar Association came out on May 10, 2019 and then recommended the resolution for the elevation of the Justice Kureshi to High Court of Tripura.
According to the resolution of, the Bar association of Bombay believes that the modification in the elevation order by the Supreme Court Collegium of the government undermines "Independence of the Judiciary" and "Would have negative and adverse effects on the Judges in the exercise of their duty and functions in the fear". The Bar Association Views the sudden elevation of the Justice Akhil A Kureshi as grave apprehension procedure adopted by the Supreme Court Collegium and also believes the reason behind "this elevation must be disclosed by the Collegium and is necessary, and would reserve the interests of Judiciary and the administration of justice".
The BBA further said it strongly disapproves of the manner in which the government had “interfered with the Collegium’s decision-making in the appointment of Justice Kureshi in particular and appointments, elevation or transfer of Judges in general, thereby threatening the independence of the judiciary”. The Bar association also stated that this sudden order by the collegium will have the adverse effect in not only the administration of justice but also the Independence of judiciary is also put on a questioning situation , also sating that the supreme court collegium must have a reason behind the elevation that is not considering the resolution by the Bar association as well lastly quoting that Under the Constitution of India " Every High Court in India enjoys Equal power and status irrespective of the geographical territory and All the Judges of those must exercise their function in the administration of Justice" and " It is the duty of the collegium that any order in not passed that contains any kind of malice.
