The Hon'ble Supreme Court of India in the year 2018 diluted the provisions of arrest in cases of discrimination against the Scheduled Tribes and Scheduled Caste. This move of the Hon'ble court saw widespread violence and protests by the communities and people blamed the Central Government for not protecting their interests in the court. The Modi government recently filed a review petition before the Hon'ble court in this matter before passing of any judgement. The Parliament, after the passing of the Court's order made certain amendements in the Scheduled Tribes (ST) and Scheduled Caste (SC) Act in order to prevent any kind of violent activities. There were many pleas which were filed in the court challenging the amendments made by Parliament as being arbitrary.
The Supreme Court partially recalled its own order given in the year 2018 and forbade the provisions of arrest of a public servant and private person. Also, a premilinary enquiry was done away with before filing of the First Information Report. This was done by the court in order to prevent misuse of the act as many false cases were filed by the SC/ST against other people. Earlier the bench comprised of Hon'ble Mr. Justice Arun Mishra, Hon'ble Mr. Justice MR Shah and Hon'ble Mr. Justice BR Gavai. The bench reserved it's order after the review petition was filed.
The Supreme Court observed that the order passed earlier was against the spirit of the Constitution. There are still many instances where people from Schedule Castes and Scheduled Tribes are discriminated. There have been many cases recently which are a proof of the fact that even after so many years of Independence these people have not got their due share of respect in the society. Therefore, it is important that no such order is given which could harm their interests.
