A student, who had been accused of murdering a student nurse in 2018 by strangling her in New York had his trial in Nicaragua, a Central American country. The accused, named Orlando Tercero, aged twenty-three is a student of Binghamton University explained the reason for murdering Haley Anderson, aged twenty-two outside the campus as he wanted a more serious relationship that is more than a mere romantic relationship with the deceased. This is a rarest of the rare legal proceeding where the crime is being committed in New York, however, the trail is taking place in Nicaragua, with a Nicaraguan prosecutor, judged by a Nicaraguan judge under the law of Nicaragua. The accused fled from New York to Nicaragua after committing the alleged crime. Later the U.S authorities had requested his extradition to the U.S. so that his trial can be commenced. However, Nicaragua had denied extraditing the accused. Thereafter, the sole way of conducting the trial of the accused was in this way, that is in Nicaragua. It is also interesting to note that the accused possess dual citizenship of U.S. and Nicaragua.
The rarity of the proceedings arises from the fact that whereas the offence was committed in the U.S, the trial proceedings are taking place in different soil. The last time such an incident happened when a person who was a Cuban had to undergo legal proceedings under the legal system of Cuba and was finally sentenced to twenty years of imprisonment for murdering a doctor in Florida.
The reason for the acceptance of the trial by the U.S. authorities in this case, is that they believe that it is just unacceptable that an individual who has committed a crime under the law of the State evades the trial and the punishment just because he is able to flee to another country. Justifying the trial they said that since he could not be extradited he had to face the trial in Nicaragua.
