A three judge Bench consisting of Hon'ble Justices N V Ramana l, R Subhash Reddy, Bhushan Gavai questioned the Governement for notproducing ordersr in the case concerning communation blackout in Jammu and Kashmir after the abrogation of Article 370. The Solicitor General of India Tushar Mehta submittd before the Court that an rejoinder was already filed against the petitioners submissions. Upon questioned by the Bench if the act of non production of the orders mandating communication blockout in Jammu and Kashmir, the Solicitor General of India Tushar Mehta argued that the orders are protected under national security. The petitioners countered this with Vrinda Grover contending that the orders were stil not placed. The Bench told the Union of India to file an affidavit withe orders and reasons for not disclosing the same. The Court fixed the next date of hearing to be on October 25th.
In the present case, many prominent women protesters who were protesting aginst the abrogation of Artcile 370 were detained by Jammu and Kashmir Police. Many of the detainees included the wife of former Chief Justice of the Jammu and Kashmir High Court - Justice Ahmed Bashir and the sisters of former Jammu and Kashmir Chief Minister Farooq Abudullah.This was the first public protest after the abrogation of Artcile 370.
Previously the Supreme Court constitued a Constitution Bench constituting of 5 Judges to hear the numerous petitions that have filed against the abrogation Article 370 of the Constitution. The Constitution Bench will be constituted by Hon’ble Justices NV Ramana, Sanjay Kishan Kaul, R Subhash Reddy, Bhushan Gavai and Surya Kant.The various petitions clubbed before the Bench are the the petition filed by Advocate ML Sharma who has a history of being penalized by the Supreme Court by filing of false PIL’s (Public Interest Litigation), petition filed by a Kashmiri Layer who challenged the constitutional validity of the Presidential Order dated August 5th 2019, the petition filed by the leaders of the National Conference (NC) and the petition filed by retired bureaucrats.
