The Hon'ble Chief Justice of India Ranjan Gogoi named the Supreme Court Justice S. A. Bobde as the next Chief Justcie of India. According to Supreme Court custom, the senior most judge will be considered as the next Chief Justice of India. One instance in which seniority was not considered was when Justice H R Khanna was not elevated to the post of the Chief Justice of India after his dissent in the ADM Jabalpur v Shukla case wherein he held that Article 21 is inviolable even during emergency in his dissenting judgement. The Chief Justice of India Ranjan Gogoi is all set to retire on November 17th of this year.
Justice S. A. Bobde is the Chancellor the Maharastra National Law University and an law graduate from Nagpur University. After graduation he practised for almost 21 years as an advocate before became a part of the benches of the Bombay High Court and even on bench of the Supreme Court, led to his elevation as a Senior Advocate of the Bar in 1998. He was elevated as a judge of the Supreme Court in April 2013 and will retire on April 13 2021. The term of the Supreme Court judges in India is generally for 9 years unlike the U S Supreme Court wherein the Justices are elected for life.
Justice S. A. Bobde was part of the Bench that decided into the veracity of sexual harrasment allegations against the Chief Justice of India Ranjan Gogoi and is also part of the Constitution Bench deciding the Ayodhya Dispute, in which the arguments came into an end after a 40 day hearing.
