The Centre, The Gujrat Government and The National Commission for Backward Classes (NCBC) has been asked to respond by the Supreme Court on the PIL filed on the matter that farmers should be included in OBC categories irrespective of their caste and religion.
The filed petition has challenged the recent office amendment which was issued by the centre and the office order of Gujarat Govt, in which the income slab has been increased from 6 lakh to 8 lakh so that more people can be included in OBC.
The petition filed by advocate Rajesh Inamdar and Gautam Talukdar on behalf of Patan, who is a resident of RajeshKumar Patel said that said “the move of the Centre and the Gujarat government “is without any basis and without any quantifiable data”.
“There was no study or research conducted by the either the CG nor the State Government. In fact the State Government has readily adopted the OM of the Central Government,”
Citing Indra Sawhney Vs. Union, in which it was held that the benefit of reservation can be extended to OBC’s and on the basis of that the petitioner said that: “The Impugned Office Memorandum and Office Order is ex-facie illegal and arbitrary and has been issued purely for political considerations disregarding the law laid down by this Hon’ble Court in catena of Judgments”.
He further prayed to quash OM and office order.

“Prepare the survey report as well as the review report about the development and progress for inclusion and exclusion of classes who are getting the benefit of reservation under the provisions of law, as well as the method adopted for identification of backward classes.
