After the acquittal of the major players in the 2G scam case, the Supreme Court has revived the order of the trial court which deferred the proceedings sine dine in a defamation case filed by the NDTV Journalist Vir Sanghvi against the Outlook.
Following a spate of defamation cases filed against the Outlook, Vir Sanghvi also alleged in one that what it proclaimed as purported secret conversations between him and certain other individuals was completely false and fabricated. Earlier, MK Venu had also filed a defamation suit against the Outlook for its unjustified portrayal while he had consistently written against A Raja.
Sanghvi clarified on his website about the lack of authenticity of the allegations and presented a detailed note on the November 27th shedding light on his role. In the particular case, Outlook filed an application stating its inability to produce the required conservations citing the fact that the Apex court has custody over them as part of the 2G Scam case. The Court by allowing the application on 30th June slept over the case for 2 years.
It finally resuscitated due to an application filed by Sanghvi for its recall. Justice Sanjeev Sachdeva accepted the proposal since the Court had already disposed off the 2G scam case. Sanghvi’s counsel Nitya Ramakrishnan and Rahul Kripalani argued that since the conservations were available with the CBI and income tax department for perusal, the respondents could access them anytime with ease. The Court noted that since the SC has transferred custody by its order on 10.01.2011 to the CBI to carry out investigation and in this context, it set aside the order dated 30.06.2014.
On 03.02.2018, Justice Sachdeva declared the need for expediting the proceedings which have been stayed over 3 years preferably within one year and assured outlook to file an application before it in case of any difficulty in accessing the record of tapes.
