Chief Minister of Bengal Mamta Banerjee in her rally on 19 December 2019, in Kolkata challenged the Central Government to go for referendum in a nation for and against of CAA under the assistance and control of any unbiased body such as UN, Inernation Human Rights and if more votes come against the Citizenship Amendment Bill 2019, then she asked the Government to step down. However a writ petition under article 32 of the Indian Constitution has been filed in the Hon'ble Supreme Court regarding her standi to hold the position of Chief Minister of West Bengal. A writ of Quo warranto was filed by a journalist name Varakiief contends that Mamta Banerjee has no right to be the CM of West Bengal and she must be removed from her esteemed position as she is going against the sovereignity and integrity of the nation.
He further contended that Chief Minister of any state in India shold not go back on his oath which he took while accepting the honorary post of CM of the state. Therefore as she went against her oath under schedule III of the Indian Constitution and therefore should not be allowed to hold this office anymore. His lawyer submitted before the SC to the bench of Justice B R Gavai, Justice Suryakant and CJI S A Bobde and contended tat Trinmool chief Mamta Banerjee should be asked to take her challenge back or must be asked to step down as a CM of West Bengal. To which the bench of Judges of SC suggested that the petoitioner should take the maatter to the respective concerned High Court first. They opined that this issue is of importance and should be considered thoroughly in the court also the claims that petitioner has made stand firm but this issue should be first taken under the consideration of the cocerned HC .
And consequently , rejcted the plea in this regard and advised the petitioner to urge the Calcutta HC first.
