We all are aware of the Competition Commission of India (CCI), a body of Government of India which is responsible for the implementation of the Competition Act, 2002 to prevent illicit activities on the competition in market. In recent times, it was perceived that the Chemists and Druggists Association of Baroda also known as CDAB and the Federation of Gujarat State Chemists and Druggists Association had dealt with some prohibited activities which were in contravention to the provisions of the Competition Act, 2002. It was noticed that one of the stockists from Vadodara, formerly called Baroda had filed an information which held that the prior order of the Commission in the year 2012, based on the continuance of the limitations and controlling the supply of drugs and medical items in the market by giving authorization to the 'No Objection Certificate' even before the appointment of stockists and introduction of the new products in the market by the pharmaceutical companies. This matter prolonged to an investigation which was under control of the Director-General, who had dealt in with a detailed enquiry which revealed about the illegitimate activities that the CDAB and the Gujarat Federation was a part of in the anti-competitive practices. It was also established that the Gujarat Federation had been carrying on some practices which were contravening to the provisions of Section 3(3) b read with Section 3(1) of the Competition Act, 2002. It was proclaimed that the office-bearers of the CDAB and the Gujarat Federation were held responsible for indulging in anti-competitive practices under Section 48 of the Act, 2002. The Commission had propelled a monetary penalty to both the associations of Rs. 1,08,588 and Rs. 11,11,549 respectively at the rate of 10% of the average income of both the associations as per the provisions of Section 27 of the Act. Furthermore, Penalties were also imposed to the office bearers of both the associations i.e., VT Shah of CDAB with Rs. 34,048 and Jashvant Patel of Gujarat Federation with Rs. 62,144 at the rate of 10% of the average income.
There was plethora number of similar cases where precise orders were given by the commission considering the interest of the public as they have been engaged in the distribution of the drugs/medicines in some or the other way.
