The High Court of Kerala had directed the State Government of Kerala to control the prices of essential commodities of COVID19. The Central Government had recently added face masks and sanitizers into essential commodities due to corona outbreak. The court had directed the government to ensure adequate supply and increase the manufacturing capacity of the said essential commodities. The court took cognizance of the said issue on PIL filed by Justice Brigade on March 18,2020. The said PIL directed the government to close down all the public gatherings such as shopping malls, schools, movie theatres, universities and tourist places. However, the court had rejected the said direction against the state government. The verdict was made by the divisional bench of Chief Justice S Manikumar and Justice Shaji P Chaly. The bench had also directed the government to inform the public on number of persons quarantined, number of cases reported and spread of this outbreak. Till now India is reported of 225 cases nationally and out of which 5 tragically died.
The court held that “We are of the view that social gatherings are now stated to be one of the reasons for the community spread disease and that social distancing is the advisory of both, the Central and State Government. It is for the Government of Kerala to closely monitor the educational institutions, universities, shopping malls, theaters and tourist places in the State and such other places, where there is possibility of large gatherings.” The court specifically mentioned that the manufacturers must not take this outbreak as an advantage and increase the price of essential commodities as included by the Central Government. The court also directed institutions and NGOs on manufacturing the essential commodities as per guidelines of the World Health Organisations. To cope up with the demands, the court had also directed the Health Department of Kerala on manufacturing of the face masks and sanitizers according to the norms of WHO. Thus, the court had directed the government to control those prices on the said outbreak.
