As a precautionary measure against the novel coronavirus or Covid-19 the Supreme Court of India had decided to held the hearing of the cases via video conferencing. The circular was issued late Sunday in which the court had decided that the hearing of the cases which will be going to be held on Monday will take place only in one court through video conference.Last Week, Chief Justice of India (CJI) S A Bobde had said that the video conferencing facility will be set up in the court to hear the matters within a week.The supreme court had ban all the entry of the lawyers in the Supreme Court Premises and if any lawyer have to appear in urgent case he can enter by taking the permission from the president of the bar.The court had also decided to shut down the chambers of all the lawyer and have given them one day to collect the necessary and important files.The apex court website had uploaded the list of urgent cases for hearing on the website of Supreme Court.To prevent the novel coronavirus or Covid-19 from spreading the judges of the court will sit in the court room while the advocates will appear and make arguments for the cases through a separate monitoring room which will be in the court premises.Chief Justice of India had directed that a bench of two judges, as may be necessary to hear extremely urgent cases,will be available to transact judicial work.The Delhi High Court and subordinate courts had also suspended its functions till 4th april 2020 but the High Courts can only hear extremely urgent cases and the district courts can hear only cases involving fresh arrest.If there is any urgent case the lawyers had to call the High Court registry and if the request is allowed then the hearing will take place over video conferencing.Same procedure had to be followed by district court also,lawyers of the district courts had to make a call to a judicial officer who will be appointed in each district before coming to present their matter in front of the judge.The Supreme Court Bar Association had passed a resolution seeking a shutdown for four weeks while the Supreme Court Advocates on Records Association asked for a two week closure.The apex court had also restricted the entry oflitigants,media person’s,legal interns.On 16th March 2020, the CJI had made it clear that there cannot be a “complete shutdown” of courts due to the novel coronavirus pandemic.
