In light of complete lockdown in India to curb the transmission of the COVID-19 virus, the National Company Law Tribunal has withdrawn the Rosters issued in pursuance of the urgent matters to be dealt on March 25 and April 1.
On March 20. The tribunal stated that due to the COVID-19 outbreak it will only hear the urgent matters till April 1, and the tribunal also extended the operations of all interim orders. These actions were taken by the tribunal due to the stringent preventive measures and lockdown. However, it has been intimated that the concerned counsels may contact the Registrar telephonically for listing of urgent matters on any day before April 1. The limitation period was also extended accordingly, with effect from March 15 till further orders.
Similar to this order, the Supreme Court also issued a general order extending the limitation period for all the courts and tribunals across the country, whether condonable or not, with effect from March 15, until further orders.
NCLT observed “ to obviate such difficulties and to ensure that lawyers/litigants do not have to come physically to file such proceedings in respective Courts/Tribunals across the country including this Court, it is hereby ordered that a period of limitation prescribed under the general law or special laws whether condonable or not shall stand extended w.e.f. 15th March 2020 till further orders to be passed by this Court in present proceedings”, a SC bench had ordered.
All the Courts have been taking preventive measures since the outbreak of this pandemic in order to curb the spread of the virus. As there always is overcrowding the tribunal or court premises, it is important on part of the tribunal or courts to hear only urgent matters and avoid the other matters till the situation is normalized.
