The High Court of Delhi had announced that breath analyser and biometric test for the protecting staff members from exposure of COVID-19. The court had directed the Central Government by issuing a notice on temporary ban on the use of breathalysers and biometric test for protecting the railway board. The Railway Board had directed all the Zonal Railways and subordinates to comply with the court’s direction. The petitioner of the matter is Loco Running Staff Association. The petitioner held that the Zonal Railways had created unnecessary complications issued by the Railway Board dated March 20, 2020. In the said letter the Board had given approval for the use of Breathalysers and Biometric tests for the railway staff. Thus, arose the cause of action of the case and the petitioner had filed a case as a concern of exposing the members to the novel coronavirus by the Railway Board. On hearing, the court had granted three weeks’ time to the Central Government to file its reply. The court had also imposed an interim stay operation of the above said letter. In the said order the court had mentioned that the railways will not be subject to the use of breathalyser and biometric test till the next hearing. The court had also added some certain directions subject to immediate effect. The court added “1. The staff will Sign On and Sign Off manually on a register Details of Sign On/Sign Off may be entered in CMS through computers by CC/data entry operations. 2. Running staff while signing On/Off should use their own pen, Common pens, if any, may be removed. 3. In order to ensure safe train working, a declaration should be taken in the enclosed format before Sign-On and Sign-Off. 4. Special watch may be kept on the staff to eliminate drunkenness on duty. 5. Surprise checks may be conducted on suspected staff by Officers & Supervisors.”
