A Full Bench comprising of Justice CK Abdul Rahim, Justice CT Ravikumar and Justice Raja Vijayaraghavan V of the Kerala High Court has extended the state of remaining in effect of all the interim orders passed by it and the other subsidiary courts to it till May 18 whereas earlier it was April 14
Starting from 25th march and ending which is now further extended upto May 18, the date of re-opening of the courts following mid-summer holidays.
Further, in fulfilment with the apex Court orders, the bench has also temporarily set free prisoners convicted of or charged with crimes having detention term of up to seven years on short-term bail up to April 30, in order to avoid congestion in jails. Remarkably, the order does not apply to regular offenders, persons with criminal background, persons undergoing trial or remanded custody in multiple cases etc.
On March 23, a bench headed by Chief Justice of India S A Bobde had brought in attention of all states and Union Territories to place a 'High Level Committees' to decide the category of prisoners who could be set temporarily free on parole for few weeks.
This court hereby provides temporary bail to all under-trial / remanded prisoners imprisoned in the jails inside the State, who face allegation of having committed crimes punishable upto 7 years or less, with or without penalty.
The temporary bail provided to the prisoners shall not exceed 30th of April or until the lockdown is shut down by the Government, whichever is earlier. In case the lock down time period is being increased beyond April 30th, the temporary bail granted will go on till such extended time. On expiry of the period of temporary bail as mentioned above, person released prisoner shall come into view before the jurisdictional court within 3 days
The High Court has also made clear that the division bench selected by it to hear very urgent cases, together with bail applications, will carry on sitting through the period of lock down.
