Jurist suggest interim solution to the on-going crisis at the Supreme Court. The rift between the senior most judges at the Supreme Court went public with their grievances with respect to the Chief Justice of India and the way he was allocating cases to various benches on Friday. This incident has been historic, for it has created furor in the entire country especially in the legal community. In an open letter addressed to Chief Justice of India Dipak Misra, four former judges of the Supreme Court have agreed with the four sitting judges of the Supreme Court- Justice J. Chelameswar, Justice Ranjan Gogoi, Justice M.B Lokur and Justice Kurian Joseph. The letter has been signed by former Supreme Court Judge Justice P.B Sawant, former Chief Justice of Delhi High Court Justice A.P Shah, former Madras High Court Judge Justice K. Chandru and former Bombay High Court Judge Justice H. Suresh. The letter highlights the need of clear rules for allocation of cases to the benches. The letter mentions that though Chief Justice of India is master of the roaster but allocation of cases to the benches cannot be done in an arbitrary manner. This issue about allocation needs to be addressed by laying clear rules and norms for allocation of benches and distribution of cases for restoration of public confidence in judiciary. Till, such rules are framed the sensitive and important case must be heard by a constitution bench comprising of five senior most judges of Supreme Court. The letter has urged the Apex Court to take immediate steps to solve the crisis and take measures to prevent abuse of power of the Chief Justice as master of roster.
