The Bombay HC bench consisting of Justice BR Gavai and Justice BP Colabawalla has recently allowed the conduction of 1st semester exams with the second semester exams to the great relief of the Bombay University LLM students who were not allowed any preparation time for their semester exams scheduled on January 23. A writ petition and a PIL were clubbed together both seeking the postponement of exams.
A petition was filed by the LLM student Imran Khan who pointed out that they were allowed minimal time for preparation of the semester exams as the admissions alone happened till January 10. The University scheduled the exams on January 23 while keeping the syllabus same as always which added a great burden on the students without the completion of atleast a month of their academic curriculum. As per the UGC and the Bar Council guidelines, there must be a minimum gap of 90 days of teaching period per semester must be allowed before the conduction of exams which is 180 days per year.
The University represented by Mr Rui Rodrigues argued that since out of the 660 student admissions, only for 19 students the admission got delayed till January 10, the rest must have found enough time to prepare for the exam.
In the interests of equity, the court ordered that the students who just got admitted will be given a choice to write the exam on January 23 or later in the semester. The Court further concluded that since not everyone got admitted late and many did find time to prepare for exams, it would be illogical to pass a blanket order cancelling the exams on January 23.
