Karnataka High Court on Friday ruled ‘Bengaluru Band’ as unconstitutional and violative of fundamental rights of citizens. As a result, pro-Kannada Outfits yesterday called off the proposed Bandh planned for Sunday. It is noteworthy that earlier a Bengaluru Bandh was announced to be effected to coincide with Prime Minister’s scheduled rally in order to drag Mr. Modi’s attention to cater to the gravity of river Mahadayi dispute between Karnataka and Goa which has been further aggravated when Karnataka resumed a canal in order to divert its water.
The decision was given by the division bench of Karnataka High Court presided by acting Chief Justice H G Ramesh. Referring to various decisions by the Apex Court, the bench observed that “there cannot be any bandh. The Supreme Court has already said that a bandh violates the fundamental rights of citizens and it’s illegal as well as unconstitutional”. The ruling came soon after the High Court made an order restraining the organization from carrying out the bandh. The ruling came in pursuance of a PIL filed by a Bengaluru based Shraddha Parents’ Association. Subsequently, the court also directed the state government and other law enforcement wings to take necessary measures for ensuring no harm caused to commerce, industry, public life in case Bandh is observed.
