The Supreme Court has come down heavily upon the centre towards its approach for filing an 845 page affidavit containing incomplete information about solid waste management across the country and said angrily that the apex court is not “garbage collector”. The apex court has refused to take such affidavit on record and clearly warned the government about its dumping of “junk” before it.
A bench comprising of Justices Madan B Lokur and Deepak Gupta said” What are you trying to do? Are you trying to impress us? We are not impressed. You are trying to dump everything on us. We are not going to accept this.” Such approach of government toward an important affidavit was considered to be careless and shameful.
The bench directed the centre to file a chart within three weeks to indicate whether the states and the union territories have constituted state level advisory boards in accordance with provisions of solid waste management rules 2016. The bench has directed the states through centre that the chart should also include the date of constitution of the advisory boards respectively of each state and UTs and it should also include the name of the members of the board and their meeting.
Looking at the outset, the counsel appearing with 845 page affidavit was unable to answer them properly. The counsel informed the court that they have received information from 22 states about constitution of state level advisory boards and have compiled the data received on record from respective states.
The court not only once, but had expressed its grave concern earlier too. It referred to the solid waste management rules 2016 and said “the duties of various ministries, like the ministry of environment and forests and the ministry of urban development, were specified in it”.
Improper disposal of waste leads to deaths caused by chikangunya and dengue and lack of such management will lead to lose of lives across the country. In 2015, the apex court had on its own taken cognisance of death of 7 year old boy. He was denied medical treatment by 5 private hospitals and due such situation his parents had to subsequently commit suicide.
