Heated debates over the Justice Loya case caused the SC to remind the lawyers to not make the courtroom into a fish market. The arguments started with Senior Lawyer Pallav Shishodia opposing any kind of independent investigative probe into the death of Justice Loya under suspicious circumstances while attending a wedding at Nagaur.
The proceedings initially started calmly with the submissions of Lawyer V giri on behalf of petitioner Tehseen Poonwalla. Then, the commotion started with the arguments made by Shishodia on behalf of another petitioner named Bandhuraj Lone. The lawyer argued that his petitioner filed before the court with regard to two conflicting reports published in Caravan and Indian Express regarding Justice Loya’s death and said that there is no need for a probe where there is just casting of aspersions from one side.
Both Indira Jaisingh and Dave argued that the petition has merely been brought to plead for closing of the matter without any further investigation into it. Dave also alleged that Shishodia had previously appeared for Amit Shah which caused a conflict of interest. After this, the arguments continued at a high-decibel level with Shishodia saying “Dave, we don’t care what you say. You can go to hell or heaven or wherever you want”.
When the Justice Chandrachud asked the parties to not reduce the debate in the Court to the level of fish market, Dave remarked that the Court shouldn’t have allowed the petition in the first place and said that their consciences were not clear. The Justice retorted by commenting that they knew how to stay true to their conscience.
When the Judge asked Shishodia to monitor his language, Salve intervened by commenting that ‘courtesy begets courtesy’. Then, Dave cast accusations against Salve and shishodia for appearing for Amit shah and trying to stop the probe into Loya’s death.
Dave then ended by saying “BCI is issuing notice to me for raising voice of truth while people like them (turning to Shishodia and Salve) who have indulged in misconduct get away. I won’t be cowed down” and also lamented the lack of action on part of the state of Maharashtra.
