Merging national elections with state polls are facing significant hurdles as the move is strongly backed by PM Modi. This move will hugely require amendments to not less than 5 articles of constitution including all those articles which relates to the duration and dissolution of the Lok Sabha and assemblies.
An internal note of the union law ministry after getting its views on this matter from election commission, has spoken about the “constitutional challenges” which will be created while paving the way for simultaneous polls in the country.
The election commission while supporting simultaneous polls has said that the “terms of state legislatures could be extended, or curtailed, to coincide with LS polls”.
The articles which may need an amendment includes Article 85,regarding dissolution of lok sabha by president and Article 172,related to duration of state legislatures, Article 174 related to the dissolution of state assemblies and finally Article 356 with Article 83 of the Indian constitution.
The election commission views were sought by the government in response to a private members bill in rajya sabha and the respective bill sets out possible amendments in the constitution. This was done to ensure that the lok sabha and state assemblies complete their full term.
Our Indian constitution is one of a federal one, where it’s imperative to get consensus of all the state governments. A coin has two sides, so do the simultaneous polls. This is an important point of view that only serves to underline the need for two third majorities in both the houses of the parliament.
