Bombay High Court while deciding a writ petition ordered the central government to make the access of the website and portals of GST easy, also to make it more user friendly and for the same have ordered union of India who is also a party of the case to file the response on or before February 16, 2018.
A bench of Justice SC Dharmadhikari and Justice Bharati Dangre was dealing with the writ petition filed by Abicor and Benzel Technoweld Pvt Ltd, a robotics and automation equipment based company against Union of India and anr. on 06 February , 2018 where the petitioner said that they got a provisional registration number under the Central Goods and Services Tax Act, 2017 and the Maharashtra Goods and Services Tax Act, 2017 but now they are not able to access their online profile on the GST network for filing their returns online.
The High Court while hearing reprimanded the government for the difficulties faced by the businesses because of the poor execution of this high profile tax reform. They also mentioned that same tax was introduced about eight months ago in a special session of parliament in mid night, which implies that the laws made their in such an extra ordinary situation will be extra ordinary in nature but if such law when implemented is not available for an easy access for the ordinary citizen then it is of no use at all. According to the number of issues coming it is clear that this regime is not tax friendly. And it is necessary to improve the implementation of this law even for preserving the reputation of this country since on one hand we are welcoming foreign companies to invest here.
