The three petitioners with the same prayer argued that the communalization of news, especially fake news, damages the spirit of secularism in the country. It challenged the basic structure of the constitution as well as the preamble which declared India to be a secular country where all the religions are practiced and tolerated.
The mantle of upholding this secular structure is not only on the government but media also has to play a significant role in the same. The news revolving around the country that is circulated by the media houses affects and governs the mind-set of the people, so much so that it has a heavy influence on the general population. Callous and fake reports by the media houses that invoke the spirit of communalization harm the secular fabric of our country and stand to be in violation of the law. Thus, in the instant case, rapid action by the center is the need of the hour as considerable time has already lapsed.
