The 8 members of Tablighi Jamaat, including 6 foreigners acquitted under section 51 of national disaster management act, 2005, section 188, 269, and 270 of IPC and section 13 and 14 of foreigner's act 1946 were granted bail by the Madhya Pradesh High court on 21 may, Tuesday. The 2 accused members belonging to India and rest 6 from foreign countries had attended the Jamaat’s meeting, takes place at Nijamuddin Markaj of Delhi which had spotted as one of the major hotspots of COVID-19 cases or coronavirus patients. The counsel for the accused contended that the two similar situated accused, facing trial arising out of same crime number and allegedly committing similar offence, were enlarged on bail by the lower court on April 30.
The Single Bench Judge observed while granting bail to the members of the Tablighi jamaat that if this is not in dispute that present applicants are similarly situated qua (the 2 other) and their cases are arising out of same crime number, there is no justification in putting the present applicants to a comparatively disadvantageous position.
Further the judge held that I deem it proper to grant bail to the accused on the same conditions on which bail was granted by the court said in the aforesaid instance, and allowing the bail application.
