In the wake of continuing orders for the refusal, the Mumbai Police Command issued another order on May 23. Now the order, along with the social media usage rules, has also called for people who speak negatively of the State Government.
The gag order, signed by Pranaya Ashok, deputy commissioner of the Mumbai Police, to work, documented the many issues the Government is facing with the dissemination of new information, misinformation and other content that is not relevant to various social media platforms. Along with the restrictions on the use of communication media, the order, issued under section 144 of the CrPC, specifically directed legal action against those who criticized the State and its operation during COVID-19 sessions.
The order, which runs from May 25 to June 8, among other orders, "Prevents any person from seeking public trust in their government actions and actions taken to prevent the spread of COVID-19 virus and to endanger human health or safety or disruption to public order." this Prohibitory Act will be prosecuted under section 188 of the IPC.
Justice Anjana Prakash, a former Patna HC judge, in response to the Mumbai gag order, told the Wire, "The gag order is illegal and is above section 144 of the CrPC.
He further said, “In a democratic government, all institutions should operate within set limits. Therefore, for a magistrate to deny a citizen a view of a contractor is not only illegal but also offensive.
