A memorandum was submitted on Friday to President Ram Nath Kovind, by a delegation of MPs from congress, CPM and 13 other opposition parties demanding a probe by special investigation team into CBI Special Judge Brijgopal Harkishan Loya’s death. The Memorandum was signed by 114 parliamentarians who drew the attention of President towards the government’s constant assault with the democratic values and traditions since 2014.
While looking into the circumstances surrounding the Judge Loya’s death, the memorandum referred to claims made by congress leaders like Kapil Sibal, Salman Khurshid, Vivek Tankha and Randeep Surjewala during a press conference which was recently held. Mr.Kapil Sibal has even raised several issues regarding the death of Judge Loya’s. Two of the Judge Loya’s associates- Advocate Shrikant khandalkar and retired Judge Prakash Thombre are under the circle of suspicion. He had alleged that Judge Loya told them regarding the pressure he was facing to “exonerate” the accused in the Sohrabuddin murder case. Subsequently, both of them died mysteriously.
Focusing on the evil game in judge Loya’s and his associates death, the memorandum has clearly demanded that it is a great threat to the democracy, where the lives of judges and lawyers are jeopardized for doing their duty while delivering justice. Therefore it’s a high time that Supreme Court should intervene into the matter and deliver justice to the dead.
The bench consisting Chief Justice of India Dipak Misra, Justice AM Khanwilkar and Justice DY Chandrachud are currently hearing two petitions and several intervention application demanding an independent probe into the death of judge. The allegations first appeared in two reports by The Caravan Magazine which cited detailed interviews of Judge Loya’s family including his wife and son. The article goes on to question the manner in which the trial took place, clearly violating the guidelines set up Supreme Court for the case.
