Amulya Leona Noronha, the 19-year-old student who was charged with the sedition for allegedly raising anti national slogans at Asaduddin Owaisi’s anti Citizenship Amendment Act rally on February 20, has withdrawn her bail application filed before the High Court of Karnataka. Amulya was arrested on February 20 and booked under sections 124-A punishment for sedition, 153 (A) -Promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and doing acts prejudicial to maintenance of harmony, 153-B- Imputations, assertions prejudicial to national-integration., 505(2) Statements conducing to public mischief of Indian Penal Code (IPC). She was sent to judicial custody after being held under Police custody for five days and has been in prison since then.
The withdrawal of the bail application was made before Justice K Natarajan, Single Judge Bench, the court allowed Amulya to withdraw her bail application and accordingly, disposed of the criminal petition. A bail application was filed before the metropolitan magistrate court and was withdrawn on March 6th as it was not competent to grant bail in cases registered under sedition.
The court also clarified in the hearing the petitioner when have exhausted all the remedies before the Sessions court have the liberty to approach the High Court. The order reads as followed:
“The Criminal Petition is dismissed as withdrawn with a freedom to approach this to higher Court after exhausting all the remedies available before the Sessions Court”. Order said
The Karnataka Police last week had submitted a counter report in response to the bail application filed by the petitioner before The High Court that the petitioner is an influential person and may tamper witnesses by influencing them, if bail granted.
The statement filed by the police before High Court stated that Amulya was charged with sedition for raising ‘Pakistan Zindabad’ slogans which impose a threat on security and integrity of India and might repeat the same if granted bail, police further added.
