A group of Judicial officers have written a letter to both Chief Justice to Gujarat High Court and Chief Justice of India S.A. Bobde regarding the relaxation from wearing black robes for Subordinate Judicial officer as well. The letter was written by h. JB Dhadhal, ADJ(R); Sh. NM Vyas, ADJ(R); Sh. Yashodharaben Pandya, PDJ(R); Sh. PA Vaghela, ADJ(R); Sh. BL Dabhi, ADJ(R); and KP Vegad, SrCJ, mentioning that the HC’s order giving relaxation of dress code to only advocates and not to Judicial officers is very ‘discriminatory’.
The letter was mentioning the order of Gujarat HC circulated on May 15, which relived the lawyers appearing in HC and subordinate court from following the dress code. The relaxation was given in the light of corona outbreak as the long black robes "makes it easier to catch virus". The judicial officers were agitated as the circulation did not make any mention of Judicial official inspite of the comment of CJI Bobde that judges, lawyers should not wear jacket and gown for the time being as it "makes it easier to catch virus".
The letter was addressed to CJ of Gujarat High Court Justice Vikram Nath and the copy of it was sent to the CJI Bode. The letter says that “We undersigned are painfully surprised that such precautionary measure of protection to Judicial Officers of Subordinate Courts, to contain spread of Coronavirus (Covid-19) among them, is not considered at par with the Advocates while issuing this circular. This has brought feeling of discrimination in minds of Subordinate Judicial Officers and their family members."
The letter pleaded the judges to direct the concerned branches of High Courts to circulate the same order giving relaxation to judicial officers from wearing black robes. The letter says that "Such decision, if taken, will bring feeling among Subordinate Judicial Officers that Hon'ble High Court is kind enough in providing protection and safety to them also, like it did in case of advocates appearing in subordinate Courts,"
Earlier, the apex court relaxed the dress code for lawyers appearing through video conferencing for the time being. So the Bar Council of India also issued the same administrative orders for the advocates throughout the country.
