The High Court of Delhi in a PIL has sought to give directions to the transport department of Government of Delhi to provide one-time benefit of Rs. 5000/- to lifetime Public services vehicle badge holders during COVID-19. The High Court granted 10 days to the transport Department to clear the dues by depositing by depositing amount of Rs. 5000/- into the bank account holders of the eligible non-chip Public services vehicle and for non-chip vehicle amount of Rs. 1000/- in terms of the format prepared. The petitioner contended that it had made several representations to respondent as the financial assistance promised was not provided thus the present petition came to be filed. Thus, as a last opportunity court gave the respondent a time period of 10 days to transfer funds into the accounts, whose grievance has been espoused in the present petition.
The matter was heard through video conferencing method by a divisional bench of Justice Hema Kohli and Justice Subramonium Prasad of Delhi High Court. The Bench stated that , the Transportation Department has already delayed the assistance package which was announced early before in April 2020 and now it is the end of May , thus there was enough time for the transportation department to have processed all the application of the PSV and should have released the funds to those who were eligible.
The package was announced by the chief Minister of Delhi on 2nd of April 2020, of Rs 5000/- to auto rickshaw, e-rickshaw, gramin sewa vehicle drivers as a compensation for loss occurred on account of COVID-19 outbreak.
The PIL has been filed by a non-profit organisation Nayee Soch Society through Advocate, Dr. M.K. Gahlaour who sought to give direction to the transport department.
The learned council of the transport department submitted that they have identified 11,780 applicants who were eligible for holding non-chip public services vehicle through a separate web portal programme developed for such applicants and they also stated that out of the said eligible 11,780 applicants, 4,835 applicants have received the compensation amount of Rs. 5000/- which has been directly transferred in their bank accounts.
On being asked by the court that how much time they needed to transfer the funds to rest of 4,825 applicants , the council submitted that a period 15 days shall be provided , the court struck down the suggestion by stating that enough time have already passed thus the court grants 10 days to the respondent to transfer the fund and the court concluded by disposing of the present petition along with the pending applications.
