On Friday, Supreme Court denied to hear a plea filed by congress leader Pankaj Punia requesting to quash multiple FIRs lodged against him. The FIRs were lodged against him for posting content allegedly “hurting religious feelings" on twitter.
While refusing to hear the plea, a bench consist of Justices Arun Mishra, S A Nazeer and Indira Banerjee said that "We are not inclined to entertain this petition filed under Article 32 (right to move the Supreme Court) of the Constitution of India. The writ petition is, accordingly, dismissed," Further the bench also suggested him to file a plea in the concerned High Court to get the FIRs in UP and MP quashed.
Senior advocate Sanjay Hegde, while appearing for Punia, submitted that the same FIR had been lodged in UP, MP and Haryana. He said that the FIRs lodged in UP and MP should be quashed as Punia was already facing criminal proceeding in Haryana. He also highlighted that the same FIR had been filed in three places i.e. Karnal in Haryana, Noida and Lucknow in UP and in MP.
Pankaj Punia is a former secretary of "Haryana Pradesh Congress Committee". He was arrested on May 20 for posting a tweet which enraged people's religious sentiments. The complaint was filed by a resident of Karnal in Madhuban Police Station alleging that his post had hurt religious sentiments and "promoted enmity between different groups on ground of religion" by posting a tweet. He was arrested on May 21th and the mobile phone was also discovered with which he posted the tweet. Later on 22th May, he was taken into 14 days judicial custodyThe post, which is removed now, was related to UP CM Yogi Adityanath and plying of buses hired by congress for stranded migrants.
Punia is booked under section 153A of IPC (Promoting disharmony and enmity between two groups), 295A of IPC (outraging religious feelings), 505-2 of IPC (Public Mischief) and 67 of IT (Amendment) Act 2008.
