The High Court Bar Association of Guwahati wrote a letter to the Chief Justice urging him to resume physical hearing in the court. The reason cited in the letter is the inability of Virtual courts to provide justice to the litigants. The Bar Association wants physical courts to resume working from June 1 2020.
The letter was written in accordance with the resolution passed by the HCBA in an Executive Committee Meeting held on May 26, 2020. As per the resolution, “Litigants were unable to get Justice through Virtual Courts in the Gauhati High Court.” Therefore, the Bar Association requested Guwahati High Court Chief Justice Mr. Ajai Lamba to resume working of physical courts from June 1, by abolishing Virtual Courts system.
The Resolution also stated that even government offices in the state have resumed physical working from May 26. Therefore, the court premises for physical hearing should also be opened taking in view all the safety regulations.
The letter suggested that those advocates who are above the age of 65 may be permitted to continue to argue their cases via online mode. The Executive Committee also resolved that all new motion cases should be taken in its usual course as happened before.
