The High Court of Delhi directed the Central government and Lower Court on Friday, to decide on a plea seeking payment of wages expeditiously within three months from the date of its receipt. A petition was filed before the high court for directing all employers to pay wages to their workers during the lockdown period. The petition was before a single judge bench of Justice Navin Chawla, conducted virtually through video conferencing.
The petition was filed by the employees of a Taxi Company through Advocates Mr. Satyam Singh Rajput and Mr. A.K. Sharma. It was regarding the issue of non-payment of wages and cancellation of their employment amid lockdown due to COVID-19 outbreak.
The petitioners contended that they are the employees of the company. However, the Taxi company refuted the argument by stating that the services of petitioners were availed by the said respondents only on work basis and not as permanent employees.
The bench noted that in these issues both parties shall provide full assistance to the concerned authority and shall not take any unnecessary adjournment. It disposed off the petition by stating that the matter raises disputed questions of facts which cannot be adjudicated by exercising writ jurisdiction under Article 226 of the Constitution. The petitioners were given the liberty to approach the concerned Authority under the Delhi Shops and Establishments Act, 1954.
