The Supreme Court on Thursday ordered the government of states and union territories to file an affidavit regarding the amount allotted to them under the Nirbhaya Fund towards victim compensation and details of the amount spend by them on the victims of sexual assault.
The order was passed first on 9 January 2018 where the apex court said to file affidavit but it was not followed by the government of states and union territories except Sikkim. Then the bench of Justice Deepak Gupta and Justice Madan B Lokur while hearing the PIL filed by Nipun Saxena said that “We are directing the state governments and Union Territories to file an affidavit within four weeks from today indicating the flow of allotted money which was allotted under Nirbhaya Fund.”
Justice Lokur said to government that “are you not interested in paying compensation? If not then you are not interested in giving protection to women and helping the victims of assaults”.
Director of NALSA, Surinder S Rathi said that finalization of victim compensation scheme for victims will take four weeks, and the meeting between NALSA and Government of India (Ministry of Home Affairs) will be taking the issues like disbursements and appropriate use of funds.
